Lawsuit Dropped Over Fatal Santa Monica Freeway Accident

LOS ANGELES (CNS) - Relatives of a man killed in a 2020 traffic crash in the Pico-Union area have dropped a lawsuit against the driver of a rental car who allegedly rear-ended the vehicle in which the decedent was riding.

The Los Angeles Superior Court lawsuit originally also named EAN Holdings Inc., also known as Enterprise Rent-a-Car, as a defendant in the case brought by Beatriz Pecor, the widow of 68-year-old Mark Alan Peacor, and the couple's two sons, Henry and Ralph Peacor. However, the rental car company was dropped from the case in November and on Monday, the part of the case against the driver, Jacob King, who was added as a defendant last October, was dropped "with prejudice," meaning it cannot be refiled.

The Peacor court papers do not state if a settlement was reached with King or if the case was not being pursued for other reasons. In their court papers, King's lawyers denied any wrongdoing on his part and urged dismissal of the lawsuit.

According to the suit, the Enterprise vehicle, a black 2020 BMW, was being driven west on the Santa Monica (10) Freeway on Nov. 24, 2020, and was about 200 feet east of the Hoover Street exit when it hit a 2019 Toyota Prius being driven by Beatriz Peacor from behind in stopped traffic at about 6:30 a.m.

Mark Peacor, a passenger in the Toyota, died later that day from head trauma caused by the crash, the suit filed in August 2021 stated.

The Peacors alleged King was negligent. Mark Peacor's death had a negative economic impact on the plaintiffs and resulted in the losses of his love, comfort and companionship, according to the suit.
