Family of Boy Killed in Moreno Valley School Attack Files Lawsuit

The family of a teenager in Moreno Valley who died after he was attacked at school will file a wrongful death claim against the school district.

Diego Stolz was killed after two students allegedly beat him up at Landmark Middle School. The fight, which was caught on video, quickly went viral.

According to the Stolz family attorney, the district could have done more to prevent the attack on a campus that has a long history of student altercations. The attorney states the school district also failed to take into consideration reports made by the family of bullying as well as failing to enforce the anti-bullying policies the school had in place.

The family claims Diego was repeatedly verbally and physically abused by other students during his seventh grade school year in 2018-2019. Diego's guardians said they made several complaints to the school staff about the bullying he suffered to administrators.

"It is appalling that the school, which is supposed to protect its students, failed to address aggressive bullying that was occurring on its school grounds, even after multiple complaints were made," an attorney for the family said.. "This gross incompetence by the school and its administrators led to the death of a young boy, who was subjected to horrific abuse while the administrators looked the other way. The family is devastated by the loss of Diego."

The two students who were allegedly involved in the attack have been charged with one count of voluntary manslaughter each.
