Judge likely to strike down ballot title for gas tax repeal

SACRAMENTO, Calif. (AP) — A California judge says the attorney general's description of a ballot initiative to repeal the recently approved gas tax increase is misleading.

County Superior Court judge Timothy Frawley issued a tentative ruling Tuesday saying he's likely to order Democratic AG Xavier Becerra to rewrite the ballot title and summary. Republican Assemblyman Travis Allen, a candidate for governor, is backing the repeal initiative and brought the suit.

Frawley will hear arguments on the title Friday.

He says Becerra's description would be confusing to voters because it focuses on the loss of transportation funding rather than the repeal of taxes. The description appears on petition forms and the ballot.

Becerra's office did not immediately respond to a request for comment.

Lawmakers in April boosted taxes to pay for road repairs.
