Actress Sues Harvey Weinstein in L.A. Over Alleged Sex Assaults

LOS ANGELES (CNS) - Actress Paz de la Huerta, best known for her work on HBO's ``Boardwalk Empire,'' is suing disgraced producer Harvey Weinstein in Los Angeles, accusing him of twice raping her in New York and exposing himself to her at the Four Seasons hotel just outside Beverly Hills. The actress came forward with her rape allegations against Weinstein last year, but he has not been charged by New York prosecutors in connection with her claims. 

Weinstein's attorney, Ben Brafman, issued a statement Tuesday rejecting de la Huerta's lawsuit.

``It is our understanding that the Manhattan District Attorney's Office carefully reviewed Ms. De la Huerta's claims of sexual assault by Mr. Weinstein many months ago and made a conscious decision to reject her as a complainant for obvious reasons,'' Brafman said. 

``We also believe that her newly minted version of events including her new California claims are equally preposterous and unfortunately, the product of an unstable personality with a vivid imagination.''

De La Huerta claims Weinstein raped her at her New York apartment on Dec. 7, 2010, following a party celebrating the release of a film called ``Blue Valentine.'' According to her lawsuit, Weinstein gave her a ride home then insisted on coming to her apartment to discuss ``business and personal matters.''

``Once inside of de la Huerta's apartment, Weinstein made warnings to de la Huerta about harm to her career if she did not submit to sex, then forced himself on de la Huerta and raped de la Huerta,'' according to the lawsuit. The actress claims Weinstein raped her again on Dec. 23, 2010. 

She alleges Weinstein showed up while she was doing a photo shoot, called her and said he was waiting outside. According to the lawsuit, she wanted to confront Weinstein, accuse him of stalking and ask him to ``leave her alone.''However, de la Huerta drank ``a very large quantity of alcohol out of fear and depression'' during the ride to her home, where he forced his way inside and again raped her ``through overpowering physical force.''

She also alleges that Weinstein summoned her to a hotel room at the Four Seasons Los Angeles at Beverly Hills in 2011, and she planned again to confront him and demand that he ``account for his assault on her.'' According to the lawsuit, when she arrived at his room, Weinstein was wearing an open bathrobe, exposing himself to her. She claims there was a naked woman in the room, and Weinstein asked her to ``participate in a three-party sexual encounter.'' She claims she told Weinstein to stop stalking and harassing her, then left the room, according to the lawsuit. 

Weinstein has been accused by dozens of women of sexual misconduct and assault, and he is facing criminal charges in New York. He is also under criminal investigation in Los Angeles and London. Weinstein has repeatedly denied engaging in any non-consensual sexual activity.
