LOS ANGELES (CNS) - A judge Wednesday scheduled a May hearing for a producer to explain why he has not served Dr. Dre with a lawsuit through which the plaintiff maintains the Aftermath Entertainment founder used his song without permission or compensation.
Los Angeles Superior Court Judge Cherol J. Nellon issued the order after neither the plaintiff, Micah Foster, nor an attorney acting on his behalf showed up for Wednesday's scheduled case management conference. The hearing to address the issues raised by the judge was set for May 6.
According to the breach of good faith/unjust enrichment suit originally filed last May 11 and amended on Dec. 26, Foster created a track on SoundCloud in 2013 called "The Don Big Boss Whistle 2013."
Foster alleges Dre listened to his beat and song track on SoundCloud and used it in a mix for a Kendrick Lamar song, "The Heart Part 5," without getting consent from the plaintiff or paying him. Foster also is suing Aftermath, Interscope Records and Universal Music Group Inc.
