SCOTUS Rules Ex-Cheerleader's Profane Snapchat Rant Is Protected Speech

The Supreme Court is siding with a former high school cheerleader who was suspended after going on a profane Snapchat rant about her school.

  • In 2017, Brandi Levy - who was 14 at the time - went on a tirade after getting passed over for the varsity cheerleading squad.
  • Now the Supreme Court has ruled 8-1 that the school had no right to punish Levy for off-campus speech.
  • Justice Samuel Alito wrote "the regulation of many types of off-premises student speech raises serious First Amendment concerns, and school officials should proceed cautiously before venturing into this territory."
  • Should schools be allowed to punish students for off-campus speech? What about other off-campus activity? Are there certain circumstances where punishment would be appropriate?
