Maryland Court Denies Cops' Right to Search Suspects Who Smell Like Weed

Maryland’s highest state court has ruled that the smell of marijuana isn’t enough for police to be able to search a person.

In a 7-0 vote, the ruling comes five years after Maryland decriminalized marijuana by making possession of up to 10 grams a minor offense, punishable by a $100 fine.

However, the new ruling does not apply to vehicle searches, meaning a police officer who smells pot is allowed to search the car, but not the people inside it.
