LOS ANGELES (CNS) - An attorney for a man and his wife who allege Dodger Stadium security staff members injured the husband by throwing him against a fence without warning in 2017 said he will file a lawsuit on the couple's behalf today.
The plaintiffs in the Los Angeles Superior Court lawsuit, a copy of which was obtained from lawyer Barry Novack, are Marvin and Sharie Palatt. Marvin Palatt is suing for assault and battery, negligence and intentional infliction of emotional distress, while his wife is alleging loss of consortium. The suit will seek unspecified damages.
A representative for the Dodgers could not be immediately reached.
Marvin Palatt is a violin teacher who brought two of his students and his wife with him to Dodger Stadium to celebrate his 65th birthday on July 9, 2017, according to the suit.
The team was providing vouchers that day for miniature souvenir bats, the suit states. As Marvin Palatt was obtaining a voucher, he was assaulted, battered and slammed against the chain link fence without warning in front of his wife and students, the suit alleges.
The security guards may have been off-duty Los Angeles police officers, Novack said.
The man suffered a rib fracture, but he was still ejected from the stadium, the suit alleges.
It was not clear what raised the ire of the security guards.
The suit alleges the backgrounds of the security guards were not properly investigated and that they were not adequately supervised.
