An illegal alien from Mexico, who had previously been deported 7 times, drank 12 beers and was driving at 100 mph when he crashed his van and killed a father of 3.

Nemias Garcia-Velasco, 32, lost control of his Dodge Ram work van and crashed and killed 58-year-old Silvano Torres.

The incident happened on Interstate 80 in Nebraska around 1pm last Wednesday.

Garcia-Velasco was forced out of the U.S. after two deportation hearings in 2009 and in 2011. The five other times he left were considered "voluntary returns."

He had also been convicted of having false citizenship papers before the crash.

His blood-alcohol level was .243 when it was checked at a hospital after the crash. At the time, Silvano Torres was riding without a restraint in the cargo area in the van.

Torres had documentation to be in the U.S, and had been living in Omaha for close to 6 years.

Another passenger, 16-year-old Jesus I. Gonzalez, was treated at the hospital and released the day of the crash.

Garcia-Velasco was slapped with motor vehicle homicide and his bail was set at $2 million.
