Judge Says LA County Acted "Arbitrarily" on Outdoor Dining Ban

California Imposes New Lockdown Orders As COVID-19 Cases Surge Across The Nation

Victory! Superior Court Judge James Chalfant has tentatively ruled that LA County acted “arbitrarily” when it banned outdoor dining. However, this won’t immediately restore in-person dining, due to the state’s stay-at-home order.

Chalfant says:

The county "failed to perform the required risk-benefit analysis'' before enacting the ban.
"By failing to weigh the benefits of an outdoor dining restriction against its costs, the county acted arbitrarily and its decision lacks a rational relationship to a legitimate end.”
